A Florida woman used ChatGPT to create a fake AI-generated image of a homeless man and falsely reported to police that he had broken into her home and sexually assaulted her, leading to criminal charges for false reporting.
On October 7, 2023, Brooke Schinault, a 32-year-old woman in St. Petersburg, Florida, called 911 to report that an unknown male intruder had forced his way into her apartment and sexually assaulted her while her infant slept in another room. She provided police with what she claimed was a photograph of the suspect sitting on her couch. Multiple officers, a detective, six rescue personnel, and a forensic technician responded to investigate the reported crime, with DNA samples being collected. When Schinault called police a second time with additional claims, Detective Dagni Closser examined the suspect photo and immediately recognized it as part of a viral TikTok trend called the 'AI homeless man challenge.' This trend involves users uploading photos of their homes to AI applications like ChatGPT and requesting that a homeless man be digitally inserted into the image, typically on a couch, then sharing the result with family members as a prank. Police discovered the AI-generated image in a deleted folder on Schinault's device, created several days before she reported the alleged crime. She initially claimed she had only used AI to sharpen a blurry photo but eventually confessed that she created the entire image using 'Google and ChatGPT' by typing 'a homeless man.' Schinault stated she was dealing with depression, sleep deprivation, and wanted attention. She was arrested and charged with two counts of false reporting of a crime, later pleading no contest and being convicted of the misdemeanor offense.
