In October 2023, a male freshman at Aledo High School in Texas used artificial intelligence-powered clothes-removal software to create fake nude images of his female classmates. The perpetrator took innocent photos from Elliston Berry's private Instagram account and at least eight other girls' social media accounts, processed them through AI software to remove clothing, and distributed the realistic-looking nude images via anonymous Snapchat accounts. Berry, who was 14 at the time, woke up to alarming text messages from friends alerting her that these images were circulating among students. The incident caused significant psychological distress for the victims, with Berry experiencing anxiety, shame, and fear about attending school. The male student was identified when he posted using the school's WiFi and was charged as a juvenile with distribution of harmful materials of a minor. He completed the semester in a separate building and left the school after winter break. It took eight months and intervention from Senator Ted Cruz's office to get Snapchat to remove the images. The incident prompted Berry and her mother to advocate for federal legislation, leading to the introduction of the bipartisan Take It Down Act, which would criminalize publication of non-consensual intimate imagery and require platforms to remove such content within 48 hours.
