In July 2023, comedian Sarah Silverman and authors Christopher Golden and Richard Kadrey filed separate lawsuits against OpenAI and Meta in US District Court alleging copyright infringement. The suits claim that OpenAI's ChatGPT and Meta's LLaMA language models were trained on illegally-acquired datasets containing their copyrighted works. The plaintiffs allege these books were obtained from 'shadow library' websites like Bibliotik, Library Genesis, and Z-Library through torrent systems. In the OpenAI suit, the authors provided exhibits showing ChatGPT could summarize their books when prompted, including Silverman's 'Bedwetter', Golden's 'Ararat', and Kadrey's 'Sandman Slim'. The Meta lawsuit traces LLaMA's training data to a dataset called 'Books3' from EleutherAI's 'ThePile', which was described as containing 'a copy of the contents of the Bibliotik private tracker'. Investigation revealed Books3 contains approximately 170,000 books, with roughly one-third fiction and two-thirds nonfiction from major publishers. The authors claim they did not consent to use of their copyrighted works as training material and are seeking statutory damages, restitution of profits, and other remedies through six counts including copyright violations, negligence, unjust enrichment, and unfair competition.
